Welcome to Elite Air. These terms and conditions outline the rules and regulations for the use of Elite Air's services.
These Terms apply when Elite Air is the operating carrier. Definitions include Ticket, Passenger, Baggage, Force Majeure, etc. Mandatory law prevails if it conflicts with these Terms.
Key terms: 'We/Us/Our' refers to Elite Air; 'You/Your' refers to the passenger; 'Ticket' means the document entitling carriage; 'Baggage' includes checked and cabin baggage; 'Force Majeure' means unforeseeable circumstances beyond our control.
Your ticket constitutes a contract between you and Elite Air. It is valid only for the journey shown and is non-transferable. Conditions printed on or delivered with the ticket form part of this contract.
Note: The ticket is evidence of the contract of carriage and must be presented at check-in and boarding.
Fares apply only for carriage from the airport at the point of origin to the airport at the point of destination. Fares do not include ground transport. Taxes, fees, and charges imposed by governments or airport authorities are additional and subject to change.
Flight times are not guaranteed and form no part of the contract of carriage. We may need to change schedules, cancel, delay, or reschedule flights. We will make reasonable efforts to notify you of changes. If we cancel a flight, you may be entitled to a refund or rebooking.
Passengers requiring special assistance (wheelchair, medical equipment, etc.) must notify us at least 48 hours before departure. We will make reasonable efforts to accommodate your needs subject to safety and operational requirements.
We may refuse to carry you or your baggage if: you fail to comply with applicable laws; your conduct poses a risk to safety, health, or comfort of other passengers; you are intoxicated or under the influence of drugs; you refuse security screening; or you fail to follow crew instructions.
You must comply with all safety instructions and regulations. Disruptive behavior, including but not limited to: smoking, verbal or physical abuse, interference with crew duties, or failure to follow instructions may result in legal action, diversion of the aircraft, and you being liable for all associated costs.
Our liability for death or bodily injury is governed by the Montreal Convention or Warsaw Convention as applicable. For baggage loss, damage, or delay, liability limits apply as set out in these conventions. We are not liable for damage to fragile or perishable items packed in checked baggage.
Refund eligibility depends on your fare type. Non-refundable tickets may only be refunded in case of death or serious illness (with medical certificate). Refunds are processed to the original form of payment within 30 days of request. Administrative fees may apply.
Passengers are responsible for obtaining all required travel documents including passports, visas, and health certificates. Elite Air is not liable for denied entry due to improper documentation.
We collect and process your personal data in accordance with our Privacy Policy. Your data may be shared with government authorities, service providers, and partners as necessary to provide our services and comply with legal obligations.
These Terms are governed by the laws of Kuwait. Any disputes arising from these Terms or your carriage shall be subject to the exclusive jurisdiction of the courts of Kuwait, except where the Montreal Convention or other mandatory law provides otherwise.
